We recently attended the AILA Central Florida Chapter 2025 Conference, where Visa Business Plans was proud to sponsor and spend a few days exchanging ideas with leading immigration attorneys. One key takeaway came from immigration attorney Ed Beshara, who spoke about something often overlooked—corporate titles.
Ed reminded attendees that when foreign nationals form U.S. entities, the title they choose for themselves can unintentionally create issues in a visa petition. For example, listing the applicant as a “Managing Member” in company documents may seem standard for an LLC, but to some immigration officers, it can suggest that the individual is already managing the business in the U.S. This mismatch has the potential to raise doubts and make the officer think the beneficiary is working without authorization.
Attorneys at the conference agreed that every detail matters when structuring a business for an immigration case. Titles, ownership, and the business plan must all align with the visa strategy and clearly reflect what the foreign national will do after approval—not before.
