    So how did our business plan address substantiality and marginality?

    Our client’s U.S. company had posted losses of $54,746 and $13,450 in 2020 and 2021, respectively. Therefore, the USCIS was challenging the U.S. employer’s ability to pay.

    The prevailing wage as certified by the Department of Labor was $117,832.00 annually.

    What was our approach? In coordination with the immigration attorney handling the case, we did some research and used our client’s industry benchmarks to overcome the RFE.

    Our research showed that the COVID-19 pandemic had had a major impact on the health care sector. Dentistry was effectively closed for two months beginning in March 2020 with health organizations recommending dentists see emergency cases only. For general practitioner dentists, the pandemic led to a 17.9% drop in net income from 2019 to 2020.

    Second, we highlighted that in 2021, industry revenue for dentists was expected to increase an estimated 8.0%. Further, over the 2021-2026 period, industry revenue for dentists was projected to grow, increasing at an annualized rate of 3.4%.

    Third, using projected industry growth, we projected that our client’s company’s revenue would reach $857,698 in 2021 and $980,430 in 2025.

    Lastly, using industry profitability benchmarks, we projected that the U.S. employer’s net profits would reach $195,298 in 2021 and $223,244 in 2025.

    These projected profits exceeded the $117,832 prevailing wage by 65.7% and 89.45%, respectively.

    Two months ago, we were hired to analyze and respond to an RFE that read “...The USCIS cannot determine what the size of your investment is and if your organization will have the financial ability to pay the beneficiary, the rest of the employees, and to commence doing business in the United States.”

    Visa Business Plans crafted an RFE response that included a 12-month forecasted cash flow analysis. It showed that the U.S. entity was projected to be cash flow positive. This means that the L entity was projected to have sufficient cash to cover obligations, reinvest in its business, pay expenses, and provide a buffer against future financial needs.

    The L petition was approved.

    #2 - Market-related salaries

    Mary start-up and small business owners work with no salary until their companies generate cash flow to pay them. Additionally, staff members may initially be paid below-market wages. However, the USCIS expects the managers, executives, and subordinates to earn a market-related salary, which refers to the going rate that the job market is prepared to pay for a specific role in a given geographic area.

    We recently worked in coordination with an immigration attorney to respond to an RFE that challenged the U.S. entity’s ability to pay salaries commensurate with managerial positions. Our RFE response included a thorough analysis of current job market salaries. We were able to prove that the U.S. entity was projected to pay salaries aligned with market conditions in the geographic area where it was set to operate.

    #3 - L-1 Employee Compensated Outside of the U.S.

    Upon applying for the renewal of his E-2 visa, our client Tom received a Request for Evidence (RFE) from the USCIS concerning his Indiana-based lawn care business. The RFE noted that Tom’s “investment enterprise ended 2018 with no employee wages paid” and stated that the government needed evidence that he was “developing and directing the operations of the investment enterprise.” In other words, the USCIS wanted proof that Tom was managing a company that contributed to the U.S. economy in the form of job creation.

    The prevailing wage as certified by the Department of Labor was $117,832.00 annually.

    What was our approach? In coordination with the immigration attorney handling the case, we did some research and used our client’s industry benchmarks to overcome the RFE.

    Our research showed that the COVID-19 pandemic had had a major impact on the health care sector. Dentistry was effectively closed for two months beginning in March 2020 with health organizations recommending dentists see emergency cases only. For general practitioner dentists, the pandemic led to a 17.9% drop in net income from 2019 to 2020.

    Second, we highlighted that in 2021, industry revenue for dentists was expected to increase an estimated 8.0%. Further, over the 2021-2026 period, industry revenue for dentists was projected to grow, increasing at an annualized rate of 3.4%.

    Third, using projected industry growth, we projected that our client’s company’s revenue would reach $857,698 in 2021 and $980,430 in 2025.

    Lastly, using industry profitability benchmarks, we projected that the U.S.employer’s net profits would reach $195,298 in 2021 and $223,244 in 2025.

    These projected profits exceeded the $117,832 prevailing wage by 65.7% and 89.45%, respectively.

    The end result? The USCIS approved our client’s PERM petition!
