3 “Innocent” E-2 Visa Promises That Should Make You Walk Away Immediately

If you are exploring the E-2 visa process, you are going to hear a lot of advice.

Some of it will sound helpful. Some of it will sound reassuring. And some of it will sound exactly like what you want to hear.

That is usually where the problem starts.

Because in this space, the most dangerous red flags are not always obvious. They are often wrapped in confidence, convenience, and promises that feel too good to question.

Here are three of the most common ones we see and why they should make you stop and think twice.

1. “We Guarantee Your E-2 Visa Will Be Approved”

This one sounds comforting.

It is also one of the biggest red flags in the entire process.

No one can guarantee a visa approval.

Not a consultant. Not a business plan writer. Not even an attorney.

Why?

Because the final decision is made by a government officer who evaluates each case individually. There are multiple factors involved, including how the business is structured, how the investment is deployed, and how credible the overall case is.

Anyone who guarantees approval is either oversimplifying the process or trying to win your business by telling you what you want to hear.

Neither is a good sign.

2. “You Don’t Need to Invest Until Your Visa Is Approved”

This one sounds safe.

It is also misleading.

E-2 regulations are clear. The investor must be in the process of investing and have committed funds to the business.

In simple terms, the government wants to see that you have skin in the game.

They want to know that this is not a hypothetical business. It is a real commitment.
