Response to Request for Evidence (RFE)
We Can Help Attorneys Respond to RFEs on E, L, EB-5, O-1, H-1B and EB2/NIW petitions
Despite how well business visa applications seek to anticipate questions the USCIS might have, visa petitions receive Requests for Evidence (RFE) seeking additional information.
While an RFE might seem like a setback, it shows continued interest in the application and can be overcome if handled appropriately.
Our professional RFE responses address USCIS concerns and can be the difference between approval and denial.
Some examples of past work for RFEs include:
- Customized, detailed, and industry-specific job duties that meet the four prongs of the L manager or executive classification, for both the U.S. and foreign entities
- Capitalization tables for L-1 visa applications
- Feasibility analyses for L-1 visa applications
- Market research for L-1 visa applications
- Impact Analysis Reports for EB2/NIW applications
- Personal Plans for EB2/NIW applications
- Business Plans for EB2/NIW applications
- Business Plans for EB-5 Direct Investment applications
- Business Plans for E-1 and E-2 visa applications
- Expert Opinion Letters for E visas addressing substantiality and marginality
- Expert Opinion Letters for E1 visas addressing substantial trade, principal trade, and existing trade
- Business Plans for O-1 visa applications
- Business Plans for H-1B visa applications
How to Handle a Request for Evidence (RFE)
To handle an RFE, start it as soon as possible to ensure you have enough time to prepare a thorough, accurate response. Consider that you need time to gather documents, prepare explanations, and mail the response back to USCIS before the deadline. It is recommended to go over it with the immigration attorney handling the case to ensure that nothing is missed.
In tandem with your immigration attorney, begin by reading the entire request carefully. You will only receive an RFE one time, which means you will only get one chance to respond to all the questions that the USCIS might have about your application.
Be sure to review your application completely and mail your documents and mail your documents early so that they arrive by the deadline. It is also advisable that you have a way to track the package and confirm that it was delivered. For your records, you should also keep a duplicate copy of the request and your entire response.
